You CAN own a building or structure outright (like a condominium unit or a house).
You CANNOT own the land it sits on in your own name.

This is the single most important rule. So, this leads to two main paths for property ownership for foreigners.

What is "Freehold Condominium" ownership?

This is the simplest and most popular way for foreigners to invest. The Condominium Act allows foreigners to own a condo unit 100% in their own name, registered with the government, with a secure title deed (called a Chanote).

There's one key condition: the "49% Foreign Quota." This means that in any single condominium project, a maximum of 49% of the total sellable space can be owned by foreigners.

The remaining 51% must be owned by Thai nationals or Thai companies. As your consultant, my first check on any condo you like is to confirm it's still within the foreign quota.

So, I can't buy a house with a garden? What are my options?

Since you can't own the land, you cannot buy a house in the same way you buy a condo. However, you have two very secure and common methods to control both the land and the house:

A)Long-Term Leasehold: You lease the land from the Thai owner for a period of 30 years. This lease is a rock-solid, registered contract with the government's Land Department. The contract can also include prepaid options to renew for two further 30-year terms (totaling 90 years). You own the house itself, and you have exclusive rights to the land for the duration of the lease. This is a very safe and standard practice.
B)A Thai Limited Company: You can set up a Thai company, which can then legally purchase the land and house. You would be the director of this company. By law, the company must have majority Thai shareholding (51% Thai, 49% foreign). This requires expert legal advice. A reputable law firm will set this up to ensure you, as the foreign director, retain complete control over the company and its assets (the property). This is very common for high-value villas and pool homes.

The Buying Process - Step-by-Step

The process is clear and secure. Here are the steps:

Step 1:Make an Offer & Place a Deposit: Once we agree on a price, you'll sign a simple Reservation Agreement and pay a small, refundable deposit (typically 50,000 - 100,000 THB) to take the property off the market.
Step 2:Due Diligence (The Important Part!): This is where your lawyer earns their fee. They will perform a complete check on the property. This includes verifying the title deed is real and free of debt, confirming the foreign quota in a condo, checking building permits, and ensuring there are no legal issues. Never skip this step.
Step 3:Sign the Sale & Purchase Agreement (SPA): Once due diligence is clear, you'll sign the main contract. This details everything: the price, payment schedule, transfer date, and exactly what's included in the sale. At this point, you'll typically pay a larger deposit (e.g., 10-20% of the price).
Step 4:Arranging the Money Transfer (Crucial for Condos): To buy a freehold condo, you MUST prove the funds came from outside of Thailand. You will transfer the money from your overseas bank account to your bank account in Thailand. Your Thai bank will then issue a special document called a Foreign Exchange Transaction Form (FET) or a TT-3. This form is required by the Land Department to register your ownership. It's a simple process, but it is not optional.
Step 5:The Final Transfer at the Land Department: On the agreed-upon date, you (or your lawyer acting on your behalf) will meet the seller at the provincial Land Department office. Here, you will pay the remaining balance of the sale price, the government taxes and fees are paid, and the official title deed is updated to show your name as the owner. Congratulations, the property is now legally yours!

What are the typical taxes and fees when buying?

The total cost is usually around 3-6% of the property's value, but it varies. The main fees are:|

Transfer Fee: 2% of the government's appraised value of the property.
Stamp Duty: 0.5% of the sale price.
Specific Business Tax (SBT): 3.3% if the seller has owned the property for less than 5 years.
Withholding Tax: Calculated based on the seller's circumstances.

Who pays for what is part of the negotiation. Very often, these costs are split 50/50 between the buyer and seller.

Property ownership is separate from your immigration status. However, owning property can support your application for certain long-term visas (like a retirement visa) by helping you prove financial stability and ties to the Kingdom.
